NYC Process Server Licensing

New York City is one of the few jurisdictions in the United States that requires process servers to be licensed. The New York City Department of Consumer Affairs (DCA) oversees process server licensing and establishes the rules that all licensed process servers must follow.

Using an unlicensed process server in NYC can result in invalid service, which may cause your case to be dismissed or significantly delayed. That's why it's critical to work with a licensed, compliant process serving agency.

Who Needs a License?

Any person who serves legal papers for compensation within New York City must hold a valid process server license issued by the DCA. This includes employees of process serving agencies and independent contractors.

Exemptions

Attorneys, sheriff's deputies, and parties to a lawsuit serving their own papers are generally exempt from licensing requirements. However, professional process servers hired by law firms must be licensed.

Prohibited Conduct

Cannot use deception, threats, or force. Cannot enter premises without permission or serve papers at unreasonable hours.

Fee Disclosure

Provide clear fee schedules and cannot charge more than quoted without prior client approval.

Maintain proper liability insurance to protect clients and the public from potential damages.
